COMMISSIONER'S DIRECTIVE 709 - ADMINISTRATIVE SEGREGATION

Why was the policy changed?

The changes have resulted from recommendations following the Task Force on Administrative Segregation, audits, Boards of Investigation reports and Executive Committee decisions. The Commissioner's Directive (CD) also formalizes in policy a number of measures that have been taken by the Correctional Service of Canada (CSC) over time in the operation of administrative segregation.

How was it developed?

The policy changes were developed with Institutional Reintegration Operations, Regional Segregation Oversight Managers, Aboriginal Initiatives Branch, Women Offenders Sector, Health Services Branch, Legal Services, Security and Policy Branches.

The draft CD and Guidelines (procedural documents) were sent to all regions and relevant National Headquarters sectors and branches for review and comments, including Performance Assurance, Strategic Policy and Human Rights, Women Offenders, Aboriginal Initiatives, Health Services and Offender Management System Renewal. External stakeholders such as the Office of the Correctional Investigator and unions were also consulted. Consultation comments received were reviewed and, where required, were integrated into the policy documents.

What is new/changed?

As Institutional Reintegration Operations is the policy holder for administrative segregation, it was determined that the most appropriate place for the CD would be within the 700 series along with other case management policy CDs. The CD has therefore been renumbered from 590 to 709.

The CD contains changes in policy objectives, expanded definitions and the formalization of a number of principles.

The CD clearly identifies roles and responsibilities in administrative segregation at the national, regional and institutional levels and provides clear direction on responsibilities related to administrative segregation.

The CD has five new annexes, which provide guidelines for memorandum of understanding, segregation/admission, how to run a Segregation Review Board, Segregation Review Board report content and providing psychological opinions for administrative segregation cases.

All CSC management and all staff responsible for administrative segregation.

Who will be affected by the policy?

All staff and offenders dealing with administrative segregation.

Expected cost?

These changes will not affect the overall costs beyond the present resources dedicated to this function.
