COMMISSIONER'S DIRECTIVE 567-5 - USE OF FIREARMS

Why was the policy changed?

CD 567-5 was amended to reduce confusion when reporting a use of force and reflect a change in a referenced policy.

What is new/changed?

The phrase "exhibiting a firearm" was deleted from the definition of the "Use of firearms" as the vagueness and ambiguity of the phrase, especially in the context of determining whether reporting a use of force is required, create confusion.

In paragraph 24 (formerly paragraph 18), the reference to CD 630 - Preservation of Evidence was removed as it has been replaced with CD 568 4 - Preservation of Crime Scenes and Evidence.

Some titles and roles were also updated (i.e., "Correctional Supervisor" replaced with "Correctional Manager" in paragraph 24 and "Regional Deputy Commissioner" replaced with "Assistant Deputy Commissioner, Institutional Operations" in paragraphs 25 and 26), and a cross-reference section was added for ease of reference.

How was it developed?

The Security Branch is currently revising CD 567-1 Use of Force and requested legal advice on the issue of deleting "exhibiting a firearm" from the definition of "Use of a firearm".

The reference to old policy (CD 630) was brought forth by the Ontario region and amended accordingly.

The changes in title positions result from the review of CSC policies conducted by the Management Structures and Deployment Standards Team at NHQ.

Accountability?

All CSC management and staff responsible for the use of firearms.

Who will be affected by the policy?

Any staff member involved in the use of firearms.
