CD 081 - OFFENDER COMPLAINTS AND GRIEVANCES

Why was the policy changed?

Commissioner's Directive (CD) 081 - Offender Complaints and Grievances has been revised to ensure that complaints and grievances submitted by segregated offenders are identified daily and monitored regularly.

What has changed?

A section on offenders in segregation/cell confinement (paragraphs 42 to 44) has been added in the Special Cases section of the CD.

How was it developed?

The policy was developed by the Offender Redress Division in consultation with Legal Services and the Strategic Policy Division, and was discussed with ExCom.

Accountabilities?

Commissioner, Regional Deputy Commissioners, Assistant Deputy Commissioners, Institutional Operations, and Institutional Heads.

Who will be affected by the policy?

Grievance Coordinators/Clerks, Grievance Analysts, those involved in the offender complaint and grievance process, and offenders in segregation.

Nota bene:

Designated staff will be responsible to verify grievance boxes, once a day, in segregation ranges and all other units for cell confinement cases. The collected submissions will be brought to the office of the Grievance Coordinator before the end of that day shift.

Prior to opening the complaint or grievance file in the Offender Management System (OMS), Grievance Coordinators will verify if the griever is segregated through OMS and/or RADAR or, if necessary, a telephone call to the Correctional Manager. Should the grievance subject warrant High Priority as per criteria established in the Offender Complaint and Grievance Procedures Manual, it will be brought to the attention of the Institutional Head.

Nil.

Other impacts?

A revision of the Offender Complaint and Grievance Procedures Manual will occur to reflect the amendments to the CD.

Training for applicable staff will be required.

Technical amendments will be made to the following forms to allow inmates to self-identify their segregated status:

  • Inmate Complaint Form (CSC/SCC 0360);
  • Offender Grievance Presentation (First Level) (CSC/SCC 0103);
  • Offender Grievance Presentation (Second Level) (CSC/SCC 0103-1);
  • Offender Grievance Presentation (Third Level) (CSC/SCC 0103-2).
