Why were the policies changed?

On June 21, 2019, C-83, An Act to amend the Corrections and Conditional Release Act and another Act, received Royal Assent. The amendments to the Corrections and Conditional Release Act (the Act) are now in effect, and the corresponding changes to policy are addressed in this bulletin. Among other things, the Act eliminates the use of administrative and disciplinary segregation and introduces Structured Intervention Units (SIU) for inmates who cannot be safely managed in the mainstream inmate population.

In addition to the new CD and GLs, the amendments highlighted below are in effect immediately, and will be reflected, along with the relevant links, in the applicable CDs and GLs at a later date.

What has changed?

Elimination of Administrative and Disciplinary Segregation – CD 709 and GL 709-1

As a result of the elimination of administrative and disciplinary segregation, CD 709 – Administrative Segregation and GL 709-1 – Administrative Segregation Guidelines have been revoked. All links and references to CD 709 and GL 709-1 in all policies are no longer valid.

New Policy Direction for SIUs and Restricted Movements – CD 711, GL 711-1 and GL 711-2

A new CD and two new GLs (CD 711, GL 711-1 and GL 711-2) have been developed to provide detailed policy direction on the transfer of inmates to and from an SIU, and the management and engagement of inmates housed in SIUs and those subject to restricted movement. 

Health Care Services in an SIU and while subject to Restricted Movement

The health of individuals confined in an SIU or while subject to restricted movement will be monitored and assessed by registered health care professionals pursuant to CD 711 and the Health Consultation and Assessment for Structured Intervention and Restricted Movement Guidelines.

How were they developed?

The new policy instruments were developed by the Structured Intervention Unit team, in consultation with various NHQ sectors, RHQ, as well as with the inmates and both internal and external stakeholders.

Who will be affected by the policies?

These policies apply to all staff responsible for the transfer of inmates to and from an SIU, and the management and engagement of inmates housed in an SIU and those who are subject to restricted movement.
