Why was the policy changed?

In March 2023, Bill C-39 came into force, extending the delay of eligibility for Medical Assistance in Dying (MAID), where a person’s sole underlying medical condition is a mental illness, for an additional year.

What has changed?

The date specificed in paragraph 14 has been updated to indicate that as of March 17, 2024, individuals whose sole underlying medical condition is a mental illness will be eligible for MAID if they meet all the other eligibility requirements.

How was it developed?

The Guidelines were updated by the Health Services Sector in consultation with the Strategic Policy Division. Due to the non-discretionary nature of this amendment, no formal consultations were held.

Who will be affected by the policy?

Staff and contractors involved in the MAID process or in providing health care services to individuals requesting MAID.
