Women Offender Statistical Overview

Fiscal Year 2009-2010

Introduction

The majority of the tables in this document focus on the regional institutions (Nova Institution for Women, Établissement Joliette, Grand Valley Institution for Women, Okimaw Ohci Healing Lodge, Edmonton Institution for Women and Fraser Valley Institution. However, where appropriate, data is also included from Isabel McNeil (Ontario)1 and the Regional Psychiatric Centre (Prairies).

Here are a few key points of interest in the following report:

  1. The last inmate left Prison for Women in May 2000;
  2. Nova Institution for Women opened in 1995 and the Secure Unit opened in January 2003;
  3. Joliette Institution opened in 1997 and the Secure Unit opened in May 2003;
  4. Grand Valley Institution for Women opened in 1997 and the Secure Unit opened in October 2004;
  5. Okimaw Ohci Healing Lodge opened in 1995.
  6. Edmonton Institution for Women opened in 1995 and the Secure Unit opened in March 2003.
  7. Fraser Valley Institution opened in 2004 and the Secure Unit opened in March 2006
  8. Isabel McNeil House closed in December of 2008.
  9. There has been an increase of 18% in the federal women offender population since March 31, 2006. This represents an increase of 23% for women incarcerated and an increase of 13% for women who are presently in the community.
  10. The Prairie Region has the highest proportion of incarcerated women offenders. As of March 31, 2010 the Prairie Region accounts for 33% of the total incarcerated women offender population;
  11. On April 25, 2010 the majority of the woman offender population was classified at a medium security level (45%) followed by minimum security (29%);
  12. On March 31, 2010, 333 women (66%) of the incarcerated federal women offender population were serving time for a violent crime.
  13. Incarcerated Aboriginal women offenders (164) accounted for 33% of the total incarcerated federal women offender population on March 31, 2010. Aboriginal peoples account for approximately 3.8% of the total Canadian population2;

Definitions

The statistics in this document are presented in two different formats: 1) at a point in time, and 2) over a period of time.

1) at a point in time

This measure is designed to illustrate a situation on a specific date. Each Sunday, CSC takes a "snapshot" of the data in OMS relating to the offenders in each institution across the country. This information is then stored separately from OMS and labeled as having been extracted from OMS on that Sunday's date. These "snapshots" can then be used to compare one institution or region to another at the same point in time. By comparing "snapshots", one point in time can be compared to other points in time on an institutional, regional or national level. Data for incarcerated and community populations are often presented this way.

2) over a period of time

This measure is designed to illustrate specific events occurring between two dates.  This information can be used to identify trends in events over a period of time.  The information can be viewed nationally, regionally or institutionally and can be compared from one time period to another.  Offender admissions and releases are regularly presented this way

Incarcerated population: federal offenders housed in a penitentiary or a provincial prison with an incarcerated status and federal offenders on Temporary Absences

Community population: federal offenders on Day Parole with daily return, federal offenders in temporary detention, federal offenders on Day Parole, Full Parole, Statutory Release, and federal offenders that have been deported.

  • At year end 2009-2010 the Atlantic and the Prairie region are the only regions to have more women incarcerated than in the community.

  • Aboriginal women tended to be incarcerated rather than on conditional release. However, note that some numbers are very small (in Quebec, for example) and thus the percentages are not always representative.

  • The total number of incarcerated federal women has increased (23%) since March 31, 2006;
  • The Prairie Region has the highest proportion of incarcerated women offenders. This has been consistent since March 2006. As of March 31, 2010 the Prairie Region accounts for 33% of the total incarcerated women offender population;
  • The Ontario and the Prairie Regions have consistently larger proportions of the women offender population compared to other regions.

  • On April 25, 2010 the majority of the women offender population was classified at a medium security level (227) followed by minimum security (148);
  • 12% (58) women were classified as maximum security;
  • Nova Secure Unit opened in January 2003;
  • Joliette Institution Secure Unit Opened in June 2003.
  • Grand Valley Institution for Women Secure unit opened in October 2004;
  • Edmonton Institution for Women Secure Unit opened in March 2003;
  • Fraser Valley Institution Secure Unit opened in March 2006.

  • The number of Initial warrant of committal admissions increased 20% since 2005-2006;
  • The number of Repeat warrant of committal admissions has decreased by 11% since fiscal year 2005-2006;

Initial Warrant of Committal means that the offender has been admitted for the first time to federal jurisdiction. Repeat Warrant of Committal means that the offender has been admitted for the second time or more to federal jurisdiction.

Data included in the table consists of admissions into federal jurisdiction either as an initial warrant of committal (WOC) or a repeat warrant of committal (Repeat WOC).

  • Of the 1535 minor charges laid during 2009/2010, 1175 (77%) resulted in a guilty verdict. The majority of all minor charges laid occurred at Edmonton Institution for Women (493).

Minor Offence: is where an inmate exhibits negative or non-productive behaviour towards institutional rules governing the conduct of inmates. Minor offences are dealt within institutional "minor court" as per Commissioner's Directive 580 Discipline of Inmates. Note that the finding of "Not Guilty" was replaced with "Dismisse" in 2005.

3. An offence under any of the following provisions of the Criminal Code, chapter C-34 of the Revised Statutes of Canada, 1970, as they read immediately before January 4, 1983, that was prosecuted by way of indictment:
(a) section 144 (rape);
(b) section 145 (attempt to commit rape);
(c) section 149 (indecent assault on female);
(d) section 156 (indecent assault on male);
(e) section 245 (common assault); and
(f) section 246 (assault with intent).

4. An offence under any of the following provisions of the Criminal Code, chapter C-34 of the Revised Statutes of Canada, 1970, as they read immediately before January 1, 1988, that was prosecuted by way of indictment:
(a) section 146 (sexual intercourse with a female under 14);
(b) section 151 (seduction of a female between 16 and 18);
(c) section 153 (sexual intercourse with step-daughter);
(d) section 155 (buggery or bestiality);
(e) section 157 (gross indecency);
(f) section 166 (parent or guardian procuring defilement); and
(g) section 167 (householder permitting defilement).

5. The offence of breaking and entering a place and committing an indictable offence therein, as provided for by paragraph 348(1)(b) of the Criminal Code, where the indictable offence is an offence set out in sections 1 to 4 of this Schedule and its commission
(a) is specified in the warrant of committal;
(b) is specified in the Summons, Information or Indictment on which the conviction has been registered;
(c) is found in the reasons for judgment of the trial judge; or
(d) is found in a statement of facts admitted into evidence pursuant to section 655 of the Criminal Code.

6. An offence under any of the following provisions of the Crimes Against Humanity and War Crimes Act:
(a) section 4 (genocide, etc., committed in Canada);
(b) section 5 (breach of responsibility committed in Canada by military commanders or other superiors);
(c) section 6 (genocide, etc., committed outside Canada); and
(d) section 7 (breach of responsibility committed outside Canada by military commanders or other superiors).

(d) section 19.1 (possession of property obtained by certain offences); and
(e) section 19.2 (laundering proceeds of certain offences).

2. An offence under any of the following provisions of the Food and Drugs Act, as it read immediately before the day on which section 64 of the Controlled Drugs and Substances Act came into force, that was prosecuted by way of indictment:
(a) section 39 (trafficking in controlled drugs);
(b) section 44.2 (possession of property obtained by trafficking in controlled drugs);
(c) section 44.3 (laundering proceeds of trafficking in controlled drugs);
(d) section 48 (trafficking in restricted drugs);
(e) section 50.2 (possession of property obtained by trafficking in restricted drugs); and
(f) section 50.3 (laundering proceeds of trafficking in restricted drugs).

3. An offence under any of the following provisions of the Controlled Drugs and Substances Act that was prosecuted by way of indictment:
(a) section 5 (trafficking);
(b) section 6 (importing and exporting);
(c) section 7 (production).
(d) and (e) [Repealed, 2001, c. 32, s. 57]

4. The offence of conspiring, as provided by paragraph 465(1)(c) of the Criminal Code, to commit any of the offences referred to in items 1 to 3 of this schedule.
